Driver’s License Suspension: Prom Season and Penalties for Underage Alcohol Infractions

With prom season underway, I thought it an apt time to ensure that parents and youth alike are updated on current state law with respect to underage alcohol-related infractions and the ramifications for one’s driver’s license.

As in our time, the prom remains a hallmark of the high school social scene, and something that we all want the “the kids” to look forward to and enjoy. Then and now, none want the magic of prom season marked by any moments that mar what otherwise would be a wonderful night.

Something that has changed since “back in the day” is the extent and depth of penalties for alcohol-related incidents involving an underage individual.

Someone under 21 could lose one’s driver’s license for any of the following offenses, even if not driving a vehicle at the time of the violation:
• Misrepresenting one’s age to acquire alcohol.
• Using false ID to purchase alcohol.
• The mere consumption, possession or transportation of alcohol.

The penalties:
• A 90-day mandatory driver’s license suspension for first offense;
penalties for second and subsequent offenses increase substantially.
• Up to $500 fine.
• Notification of parents.

If the youth does not yet hold a driver’s license, penalties will begin when one applies for a license.

To help with this effort to encourage our youth to make smart choices, an information flyer about this topic is downloadable from my website. Needless to say, the law’s provisions apply at all times and not simply during prom events.

As a parent, I share your concerns about doing as much as we reasonably can to ensure fun, memorable and safe days of youth.
